Dispute Resolution

1. Informal resolution first

Before filing any formal claim, you agree to contact us at legal@calculatingwealth.com and attempt to resolve the dispute informally for at least sixty (60) days.

2. Governing law

The Terms of Use and any dispute arising out of or related to the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except to the extent that mandatory consumer-protection laws of your jurisdiction of residence apply.

3. Binding individual arbitration

To the fullest extent permitted by applicable law, any dispute, claim or controversy arising out of or relating to the Service, the Terms of Use or the relationship between you and the Protected Parties shall be resolved by binding individual arbitration rather than in court, except that you or we may bring an individual action in small-claims court for qualifying disputes.

4. No class actions

You and we agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, collective, consolidated or representative action. The arbitrator may not consolidate the claims of multiple parties.

5. Venue for non-arbitrable matters

For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.

6. Time limit

To the fullest extent permitted by applicable law, any claim arising out of or related to the Service must be filed within one (1) year after the claim arose; otherwise the claim is permanently barred.

7. Jurisdictional limits

If any provision of this section is held unenforceable in your jurisdiction, the remaining provisions remain in full force and effect, and the unenforceable provision is to be enforced to the maximum extent permitted by law.
