Educational service provided "as is"

CalculatingWealth.com, its calculators, projections, dashboards, downloads, educational articles, lessons and any related materials (collectively, the "Service") are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, timeliness or quiet enjoyment.

Limitation of liability

To the fullest extent permitted by applicable law, in no event shall Relationale LLC, Keiron Brown, CalculatingWealth.com, or their respective employees, contractors, contributors, licensors, affiliates, technology providers, successors and assigns (collectively, the "Protected Parties") be liable to you or any third party for any direct, indirect, incidental, special, consequential, exemplary, punitive or other damages of any kind, including without limitation damages arising out of or related to:

  • calculator results, outputs, estimates or illustrations;
  • projections, forecasts or scenario analyses;
  • educational materials, articles, lessons, downloads or guides;
  • investment decisions or outcomes;
  • retirement planning decisions or outcomes;
  • tax planning or filing decisions;
  • budgeting, debt, real-estate or insurance decisions;
  • financial planning decisions of any kind;
  • AI-generated or AI-assisted educational content;
  • reliance on third-party content, advertisements or links;
  • interruption, error, defect, virus, security incident or delay; or
  • any other use of, or inability to use, the Service.

This limitation applies regardless of the legal theory asserted (contract, tort, statute or otherwise) and regardless of whether the Protected Parties have been advised of the possibility of such damages.

Aggregate cap

To the fullest extent permitted by applicable law, the aggregate liability of the Protected Parties to you for all claims arising out of or related to the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Jurisdictional limits

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, the Protected Parties' liability is limited to the maximum extent permitted by law.

Essential basis

You acknowledge that the disclaimers and limitations in this section are an essential basis of the bargain between you and us, and that the Service would not be provided to you without them.
