Your obligation
To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless Relationale LLC, Keiron Brown, CalculatingWealth.com, and their respective employees, contractors, contributors, licensors, affiliates, technology providers, successors and assigns (the "Protected Parties") from and against any and all claims, demands, actions, investigations, liabilities, losses, damages, judgments, settlements, costs and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- your access to, use of, or misuse of the Service;
- your violation of the Terms of Use, the Acceptable Use Policy, or any other policy posted in the Trust Center;
- your violation of any applicable law, regulation or third-party right (including intellectual property, privacy or publicity rights);
- your reliance on, or any decisions you make based on, calculator outputs, projections or educational content;
- any content, data or inputs you submit to the Service; and
- any unlawful, fraudulent, negligent or wrongful conduct by you.
Process
The Protected Parties may, at their option, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with their defense. You shall not settle any matter affecting the Protected Parties without their prior written consent.
Survival
This indemnification obligation survives any termination of your use of the Service.
